I guess I could do a CFR on this, but that would be a waist of time.  Your thoughts on chastity are opinion only as we have no evidence at all about other worlds.  Even in our own world, what we are calling chastity is viewed through many different cultural lenses, and has been all through human history.

Now many of you keep referring to the "law of chastity".   Please point out to me where the law of Chastity as revealed by God mentions prohibition of two men holding hands, two men kissing or two men going on a date.  The only place you will find such a prohibition is in the current policies of the Church with no divine revelation to support such prohibition.  All you have is the opinions of men that such actions are wrong.  There is no doctrine against such actions.  By the way the Proclamation on the Family has never been presented as formal doctrine, just the belief of 15 men currently and even it doesn't prohibit such actions.

 

Now lets go to the BYU honor code so many of you refer too:

I still can't find that prohibition you all seem to believe exists in the honor code against same sex dating and displays of affection.

The Church might do two things to remedy this.  President Nielsen can declare a revelation from God prohibiting such actions and have it canonized as doctrine.  The honor code can be changed back to what it was before 2007 which bans such behavior.

If I were investigating BYU, I might just be a little confused about the official Church stance and reach the conclusion BYU has chosen to discriminate against queer students with no official backing from the Church or its board of trustee's.

Well given the Church has reworked the covenant of Chastity in the temple before at least some aspects can be seen to fluctuate.  Some things previously required are no longer required or vice versa.

"Same standard, disparate impact" is the sort of thing that happens all over the place.  

Consider an Applicant X who wants to attend BYU and who has a drinking habit versus Applicant Y who has no interest at all in imbibing.  The Honor Code will have a disparate impact on the former, right?  But how is X being "discriminated" against if A) the same standard applies to X and Y, B) X and Y both knew in advance the prohibition against drinking, and C) X has plenty of other school options available to him, virtually all of which lack a prohibition against drinking?

Does BYU have a "rational justification" for the Honor Code and the Law of Chastity?  Yes.  

Does BYU treat gays and lesbians "unequally in a manner that is malicious, hostile, or damaging?"  No.

Does BYU hold gays and lesbians to a different behavioral standard than heterosexual students?  No.

"Disparate impact" is usually unintentional.  See here:

Look at the Word of Wisdom.  Does it have any "disparate treatment"?  Nope.  Nobody at BYU can drink alcohol, smoke tobacco, etc.  Does it have any "disparate impact"?  You bet.  I think there are plenty of people who would like to drink if they were allowed, whereas others have no interest in drinking at all.

I'm with you on most of this, but the bolded part is a bit of a gray area for me, because heterosexuals can date people they are romantically attracted to and homosexuals can't. So it could be argued that the behavioral standards are different for each group, since one group's biology is allowed to be exhibited on campus and the other group's biology isn't.

 

And by biology I mean as it applies to the born-this-way argument, where homosexuals are born with an attraction to the same sex, making it a matter of biology and not choice.

Maybe you misunderstand me. I think there are biases at play that keep our  leaders from hearing some truths from God as far as our LGBTQ brothers and sisters are concerned. So maybe he is now speaking through faithful members like David Archuletta and Tom Christofferson. He will get His message out.

Adultery is literally defined as sexual relationships outside of marriage by a married person.   Marriage is literally defined as the union of man and woman in scripture, never once anything else.  Any sexual relationship by unmarried people is defined as fornication.

That's all scripture, not policy.

Therefore it is impossible for two men or two women to have a sexual relationship that isn't either adultery or fornication.  That's unchaste.

Secular marriage isn't scriptural either though, but the church still allows someone who was married by the justice of the peace, for example, to have sex with their spouse without breaking the law of chastity.

I just don't see how anyone can change the meaning of marriage beyond male and female AND claim that doesn't contradict the scripture.

It's simply not within the definition of the word.

Now many of you keep referring to the "law of chastity".   Please point out to me where the law of Chastity as revealed by God mentions prohibition of two men holding hands, two men kissing or two men going on a date.  The only place you will find such a prohibition is in the current policies of the Church with no divine revelation to support such prohibition.  All you have is the opinions of men that such actions are wrong.  There is no doctrine against such actions.  By the way the Proclamation on the Family has never been presented as formal doctrine, just the belief of 15 men currently and even it doesn't prohibit such actions.

 

Now lets go to the BYU honor code so many of you refer too:

Brigham Young University and other Church Educational System institutions exist to provide an education in an atmosphere consistent with the ideals and principles of The Church of Jesus Christ of Latter-day Saints. That atmosphere is created and preserved by a community of faculty, administration, staff, and students who voluntarily commit to conduct their lives in accordance with the principles of the gospel of Jesus Christ and who strive to maintain the highest standards in their personal conduct regarding honor, integrity, morality, and consideration of others. By accepting appointment, continuing in employment, being admitted, or continuing class enrollment, each member of the BYU community personally commits to observe these Honor Code standards approved by the Board of Trustees “at all times and in all things, and in all places” (Mosiah 18:9):

Be honest.
Live a chaste and virtuous life, including abstaining from any sexual relations outside a marriage between a man and a woman.
Respect others, including the avoidance of profane and vulgar language.
Obey the law and follow campus policies.
Abstain from alcoholic beverages, tobacco, tea, coffee, vaping, and substance abuse.
Participate regularly in Church services (required only of Church members).
Observe Brigham Young University’s Dress and Grooming Standards.
Encourage others in their commitment to comply with the Honor Code.

I still can't find that prohibition you all seem to believe exists in the honor code against same sex dating and displays of affection.

The Church might do two things to remedy this.  President Nielsen can declare a revelation from God prohibiting such actions and have it canonized as doctrine.  The honor code can be changed back to what it was before 2007 which bans such behavior.

If I were investigating BYU, I might just be a little confused about the official Church stance and reach the conclusion BYU has chosen to discriminate against queer students with no official backing from the Church or its board of trustee's.
