The woman’s attorney was in settlement talks with the LDS Church before an audio recording she made with former MTC President Joseph Bishop was posted by the MormonLeaks website. “Since the leak, there have been no further settlement discussions. My client deserves justice. If the settlement discussion door remains closed, then a lawsuit against the Church and Mr. Bishop is our remaining option,” the woman’s attorney, Craig Vernon, told FOX 13 on Thursday. I agree that this woman "deserves justice." What that means, however... Quote Police reports released under public records requests detail the woman’s accusations against Bishop and also show that very little was done about it. Brigham Young University police were contacted in November 2017 to investigate the woman’s claims that dated back to 1984 when she said Bishop attacked her in a storage room. “She resisted and he then ripped her blouse open, pushed her on the bed, ripped her skirt, and pulled down her panty hose and garments. [Name redacted] then said sexual intercourse occurred without her consent…” the report stated. That seems to be a bit different from what she says in the recording. Quote The BYU police report said that Joseph did admit to some inappropriate conduct, but denied any rape accusations. “Joseph told us that he did go to his small MTC preparation room in the cafeteria area with [name redacted]. Then while talking to her he asked her to show him her breasts which she did. When asked to explain why his account about the rape was different that hers, he said he either can’t remember it or that [name redacted] was exaggerating her account,” the report said. A note attached to the report from deputy Utah County Attorney David Sturgill said he would have pursued a criminal case against Bishop — except the statute of limitations on sex crimes had expired. “I have no reason to doubt the victim’s disclosure, and would have likely prosecuted Mr. Bishop, but for the expiration of the statute of limitations,” he said. The statute of limitations is likely going to be implicated in the civil suit. But then, maybe Quote The woman may not be able to get prosecutors to pursue any of her allegations against Bishop because of a statute of limitations, but laws recently changed by the Utah State Legislature will allow her to pursue civil litigation. A bill co-sponsored by Rep. Ken Ivory, R-West Jordan, and Rep. Angela Romero, D-Salt Lake City, removed barriers to the statute of limitations for civil lawsuits over sex abuse claims. “I’m very gratified that any steps we can take to help victims in these situations heal and seek redress and have the cost of that harm be put on the perpetrator,” said Rep. Ivory, who attended the MTC as a Mormon missionary during Bishop’s tenure. Rep. Romero said it was important for alleged victims to be able to have their day in court. “Oftentimes as we’re seeing in this particular case, they’re shamed, they’re accused of making false allegations,” she said. “This gives them the opportunity to present what happened to them and maybe get justice.” Wow. So far I'm not able to find any recently-enacted laws pertaining to statute of limitations issues on civil sex abuse claims which were sponsored by Ken Ivory and Angela Romero. I did find one enacted in 2016, Utah Code Ann. § 78B-2-308, which took effect in May 2016, which was sponsored by Ivory and Romero (and others). However, this statute only extends the limitations period for victims of sex abuse who were under 18 at the time of the abuse. I'll keep looking. Thanks, -Smac

The seriousness of the crime is hopefully matched by the quality of the surviving evidence; I think that is part of the intent to have these laws in a day when our resources for pursuing criminal acts are greater than ever before.

Also, there's another story out there that has come to life of two brothers who went to Pres. Tingey about a relative that sexually abused the one brother and groomed the other, back in 1994, I believe. They told Tingey because they'd heard their relative was about ready to serve as a Mission President. The brothers thought the church might want to know what their relative did to them and this relative lived next door to Pres. Monson. Mormonstories had it live on FB, but will soon be put up as a podcast. Turns out the brothers had another relative say it happened to him as well. Pres. Tingey said he would get back with the brothers and never did. And the relative went on to serve as a Mission President and after that in a stake presidency. I'm just sick of the excuses out there that the church doesn't know about these things, and doesn't cover for these abusers. Sick of it. I never thought the LDS church would do what the Catholic church did to cover-up for priests or move them to another parrish. ETA: JK beat me by a hair! Edited March 23, 2018 by Tacenda

Kudos to this man for speaking up..... and for those who are still trying to make an issue of women who don't speak up immediately....notice this guy didn't want his name used. BYU students commonly work on site at the MTC. The former employee said they were told the room was “used by the previous MTC president as a place he would take naps and sometimes pray and also watch [Mormon Tabernacle Choir] videos to help him relax.” “Based on the nature of the basement alone it would be shocking for anyone to take a sister missionary down in that basement for any reason. It was very dirty, dusty, [with] water dripping, running down the walls. It was a dark dank smelly place,” the person told 2News. “That’s why the fully built out little room down there was so odd. It had nice floors, walls, ceilings but no windows. It looked like almost any other training room in the MTC with the exception of the bed of course. It was just really odd and totally out of place.” The former employee told 2News they felt compelled to share their experience after hearing Bishop’s accuser’s story. They said “There is no earthly reason she should’ve known that room existed, and no reason anyone should’ve been in the room alone with her.” 8

I think Elder Joe J. Christensen was the MTC Pres. prior to this fellow, and I can't imagine him having a bed in a basement, so maybe it was a new thing?

It was my freshman year in high school and listened to Van Halen "1984" album. It is always amazing to find how suing for some money this many years later eases the pain. Must be getting close to retirement age and needs enough to make it through ok.
