Okay... what say we get back to the OP... I think we understand the various points that have been made with learning on all sides...

Let's get back to the need for information and/or advice for MorningStar... she's still needing advice. Hopefully she'll see CB's offer to help if she will PM him, because when he tried to PM her the mailbox couldn't accept it...

I had a car plow into me, total my car. I was trying to deal with a very shaken little girl, the police....  And someone walks up and slips a business card into my hand. It was for a lawyer. That is an ambulance chaser ;-)

 

MS, you need to be keeping track of all this stuff, although on some stuff you need to show money out of pocket rather than an assertion that it is a hardship. You can get an attorney on contingency. They will take 30-40% of your settllement, but it costs you nothing except out of pocket expenses, like court fees. (I sued an attorney for malpractice.)

 

And you go for the best lawyer not the cheapest. It matters.

Perhaps MS could edit her opening post (is there anything in the remarks themselves that is a problem that anyone can see?) and the mods can edit the title to remove the problematic phrase and then the mods can delete any off topic comments so both the offending remark is dealt with and we can get any info that she needs to her in focused manner?

I am not hurting now. I am just comparing how I was treated for expressing my feelings in 1989 and how today.

My hurting comment was in respnse to someone who said she MS is hurting, so she everyone should back off.

CB, I'm sorry if I was short with you. But did you take time and read what MorningStar was saying? Maybe if you were a woman and full time mother you would understand a little better why I think you should have let whatever she said slide.

I find myself caught in between on this thread... between a friend I've known for some time... and come to understand her humor as she posts... MorningStar...

and, CountryBoy, who I've recently discovered and come to know as family... cousins...

He does not know MorningStar as I do... does not know her humor... only saw her reference in the thread title to a term that is part of the continual litany of jokes, some uncouth, about his profession as a lawyer... a litany that has become tiresome at best...

He expressed offense at the broad brushstroke painted about ambulance chasing lawyers... particularly on a board such as this. 

And we jumped on him as if he had no right to feel any resentment or offense... I would hope two things... one that when MS reads these posts, that she will understand that while not intended, her term "ambulance chasing lawyers" carried a sting for CB because he tries to be honorable in serving his clients... and acknowledge that such a term can be offensive...

and then two, that CB will understand that no offense was intended, and we in turn will see that jumping on the one that was offended was not the way we should behave...

my goodness...I have never ever been treated like this before...except when i left the church due to the Mormons who chastised me for losing my testimony.

 

I had really hoped Mormons had changed.

 

Again...lesson learned.  If offended, stay quiet...but offend all you want...you will get sympathy

How did you get ambulance chasing lawyer out of my title?  Clearly I said all lawyers are hot and that I want to chase them with an ambulance.  Hubba hubba!!! :wub:

No worries, CB.  I'm sorry if it came across as all lawyers are ambulance chasers.  I have a friend who has been asking me for the last 5 months, "When are you going to get one of those ambulance chasing lawyers?"  She also doesn't mean all lawyers - just the kind that Juliann mentioned.  I admire anyone who goes to school for that long! 

 

A friend of mine recently had jury duty and once he was able to tell us what the case was, he said it was a wrongful death suit.  The widow had been offered millions of dollars and her lawyer insisted they should go to trial because she could get millions more.  So that's what they did.  She ended up getting zero because the jury felt a completely different party was responsible for the death.  I don't know if I would know a good lawyer if I found him or her.  The idea of having to drag my baby to one more place and have to feed her in an uncomfortable chair is another thing deterring me from doing it.  I have 5 kids - one in Kindergarten and with my appointments as it is, I'm always having to ask someone to get her off the bus in the middle of the day because she's half day.  I'm overdue to see the dentist because it's very painful to be on my back for that long.  The MRI's today were torture!

 

My insurance company says usually the insurance that's paying the settlement will offer a lower amount than they should and that I can just write them a letter and tell them why it should be more.  I wouldn't know how to put a price on how painful/stressful/difficult this has been.  It's our last child and it was supposed to be a wonderful time.  I don't have the money to hire anyone to help me.  I'll get my results in maybe a few days.  If it turns out I need surgery, then I think I will definitely have to go the lawyer route.  I just don't want the insurance company to interpret it as me attempting to get a huge amount of money out of them for me to spend.  Yes, I should be paid for pain and suffering, but I really need paid help that will be dependable.
