Same Gender Marriage Children

Recommended Posts

Posted (edited)

Not another ss marriage thread. Please don't go there.

TrueSituation: a co-worker in a SS marriage somehow became with child and has a little boy.

Her partner has somehow become with child and is expecting a girl.

Question 1: will these children be brother and sister?

Question 2: they do not share fathers or mothers, so what are they?

Question 3: could they later legally marry each other?

Question 4: can or should they be adopted by the partners?

Question 7: if they were fathered be the same man, would they be step-siblings?

Question 8: if they share a biological father, does he play a legal or moral role in their lives?

Question 9: would he be a polygamist?

New question 10: if the SS couple have 2 children of the same sex, could those children legally form

a civil union or a SMS marriage?

Other questions?

The legal situation probably would be the same as for stepsiblings who are unrelated to each other by blood.

I've slept 16 hours in the last 24.....don't know why, but it feels great except for the fact I will likely be getting tired again when the sun come up, lol.

1. They'd be half brother and sister.

2. Immaterial

3. No

4. Don't know of any reason they couldn't

7. Could's be

8. If conceived through I.F. . No

9. No

10. No. Legally they are too closely related.

If the parents are legally married, then the children are siblings and no they would not be able to marry under the normal rules. (This happens with any artificial insemination pregnancy or surrogacy, so it is not unique to ss marriages.)

What blood relationship would they have?

If the parents were legally married, I suppose it might be related to adopted children more than step....which would make them full brother and sister even if there was no relation by blood.

What is the relationship being siblings where a child is fathered using the sperm of a donor? They are full siblings IIRC because the father is the legal parent even if not the biological parent.

I see that rpn had the same idea while I was still writing. With artificial insemination, there might even be no blood relationship so that would be pretty much the identical situation so I would suggest looking at any legal implications for that situation if you were wondering about the legal implication of nonbiological siblings in a legal SS marriage.

Question 1: Yep, probably. Don't need blood to be siblings. Unless the couple split and the children weren't together after that then I would assume I'd treat them like siblings

Question 2: Siblings that are not blood related.

Question 3: Eww, who'd want to? Seriously, when you've been raised with a person you consider a sibling this usually doesn't come up period.

Question 4: If they're legally married I'd assume they wouldn't have to. But I don't know much about how that works. I'd assume that's up to the partners. A assume they could but know little about legal laws.

Question 7: No, half siblings. Step siblings are siblings by marriage. Half are those that have one blood parent in common.

Question 8: Depends on what the women decided.

Question 9: No. Not married to them.

New question 10: Don't think so. Have no idea. But again, eww...who'd want to? I have a ton of half-siblings and my half-siblings have siblings too. Even though I've only met a few and am not technically related, I find the idea weird. These children would, likely, be raised as siblings from the get-go. Ya just don't go there.

I don't see that any of these questions pertain to only children of SS marriage. You could ask the same question about children of divorced parents who remarry or children who are adopted and are not biologically related. I'm sure there are plenty of laws already on the books that pertain to all of these situations.

This kinda reminds me of the Romanis. Though they don't practice sibling marriage they do condone marriage between 1st cousins. Either way...in my culturally shaped mind this is really gross and weird.

My maternal great grandparents were first cousins. That used to be fairly common, especially in rural communities where choices for marriage partners were very limited.

Yeah, first cousin marriages are actually fairly common the world over. Definitely gross in my cultural norms, but I can see differing cultural attitudes about it and be ok. All cultures, though, have some form of rules/taboos about appropriate relationship between blood relatives. Sibling marriage is almost universally forbidden accross cultures. Since I assume the couple is in a western society, I'm going to assume their ideals about appropriate sexual unions are fairly similar. Marrying your sibling is a big no-no....even if they're adoptive. Hypothetically there's nothing wrong with it (genetically speaking for adoptive sibs). But culturally it ain't gonna happen 9.999 times out of 10. "Eww" was my way of saying, use common sense and think of how you'd feel about your own siblings.
