Utah is a one party consent state isn't it?  It's becoming quite commonplace to record sexual encounters both audio and video.  Seriously, besides this cop and his family possibly getting doxd over this woe to anyone who tries to pull this with an athlete, lot of em especially if they're poc are getting wise to rape aligations and act accordingly,at least that's what I've been told.  Know one guy irl who had his life ruined by that too, thousands of dollars, family stress and destroyed mental health and the judge still found him guilty despite there being no evidence.

No offense intended here, I have no tolerance at all for rape/violence against women, I say throw em in the nastiest prison you can find.  That being said, this stuff can backfire quite horribly.  Unless I'm missing something this sure looks like a case of privilege that social media could solve real quick, especially with so many people. Moving to Utah from California.

Deja vu! I’m just watching the news about a Blackfoot Idaho sheriff who just had felony charges filed against him for pointing a gun at a group of LDS girls who were delivering thank you notes to influential community members (he also physically assaulted their leader). A blub from the newspaper article:

The sheriff previously generated controversy in 2016 when he said that a statewide bill to streamline the collection and tracking of rape kits was unnecessary because most reports of sexual assault are untrue.

For a second, my mind went to sex and not recording. And I went “what the heck, there better not be any one party consent states out there…”

I was under the impression the rules were different for recording sexual encounters without consent.

My mistake, my phone posting can be kinda lousy at times, need my keyboard.

Hmm, good question. 

With recording I would think if it was done before the act where you could just ask if he/she gives consent, you'd be covered.  It's before the act, people are wearing clothes and there's no coercion, would think it would be legal.  Should have clarified that too. 

For those of you with sons how would you handle this?  I don't doubt for a moment the parents here do a great job of educating their kids on how to behave and watch your associations.  Guy I knew who went through this is still kinda messed up mentally, I feel for his parents.

While that would help support a claim of consent, consent means all the way through the act…the other might withdraw consent anytime by saying “stop” or “I don’t want to do this”.

In this day and age of selfies where recording mutual consent might not be read as an insult, it might not be a bad idea but I would insist (if somehow I became someone who would have sex outside of marriage) that it would include that I did not give permission for any part of the act to be recorded and I retained the right to refuse consent at any moment of the interaction and my partner would have to stop immediately without pressure or just dialing back and then continuing.

Still, if someone suggested it to me, I would be concerned they were setting up a defence for rape unless I knew them pretty well.  But then I (assuming I am young and single again but retain what I have learned, but had changed my morality such I was willing to have sex unmarried) would never be making out until after many dates for a variety of reasons.
