What the heck Public Health is all about? We have a right to not have fracking of wastewater that causes some earthquakes. Good luck! The common cold isn't really much more than a nuisance, so I doubt there's much liability there. When the risk for death and serious adverse reaction to vaccine is greater than risk for disease, there is absolutely an ethical dilemma that should be considered. I don't have the right to "intentionally" (that is the key word you left out) infect someone else in some states, but not all. Not vaccinating is not intentional infection, especially when the risk of becoming infected is near zero. Good luck proving that one in court! However, contracting hep b, for example, then having sex without disclosing that you are infected might be illegal in some states, but not all.
