Bill “Papa” Lee Posted June 27, 2012 Author Posted June 27, 2012 (edited) Sorry Papa, I thought you were in hospital, my mistake.Sorry for all you are going through, the stress and worry can't be helping. Do you have friends who can do a fund raiser. I posted about a return missionary, (who's broken her spinal cord)on the news section today. Friends and family are doing a fund raiser as she has no medical insurance. Could your ward help out in this way?You are in my prayers and thoughts, I just wish it was more.I am sure the Bishop will help for a time. But I doubt he can do it for Months. He did a food oder this week. Also I have no truck anymore. I can't get a settlement from Allstate until I am well. Allstate is the insurance company of the kid who hit us. rpn Posted June 27, 2012 Posted June 27, 2012 But you should be able to get some coverage from your own insurance company and if the other company has accepted fault, at least lost wages while you are out

rpn Posted June 29, 2012 Posted June 29, 2012 (edited) Your no fault probably covers lost wages and medical. But since your medical has no doubt exceeded the original no fault coverage, it would depend on whether you had extended no fault as to your own insurance. But if the other party has agreed they were negligent and you were not, then ask them to pay wages ongoing as otherwise the eventual damage they will have to pay is greater because of all the things you've told us about. If they dispute their fault, then it is another thing, you'll have to wait until the settlement. As for strategy, if the bank won't work with you, after you've given notice of the lawsuit potential, then one strategy is to file for bankruptcy to stay the foreclosure. The only disadvantage might be that if the at fault party gets wind of that, they may press you for a lousy settlement to make the bankruptcy time frames to save the house.
