Marginal Gains Posted May 15, 2018 Posted May 15, 2018 8 hours ago, Calm said: It explains in my opinion why the sisters were not eager to report charges when they likely knew nothing would come of it legally as far as Smartt was concerned (he was wealthy at the time, had his own plane and could likely arrange legally or illegally to leave Puerto Rico at any hint of charges as well as bribe his way out) and the actual result would be potentially mistreatment by corrupt and unskilled officers for themselves. I’m guessing, but wouldn’t they have been supported and advised by the Church? In which case professional experienced lawyers could (arguable should if these sister missionaries had been sexually assaulted) have been drafted in to pursue the case(s). Which leaves some more questions about how the Church handled the situation locally. I can envisage a situation where the sisters in question refused to press charges in order to protect their own reputations. And I do not blame them if that was the case. I might be wrong, but I suspect that the sister missionaries have been, or will be at some point, financially compensated in return for keeping quiet. We know that wouldn’t be the first occurrence of such a deal.
JAHS Posted May 16, 2018 Posted May 16, 2018 "The LDS Church and a former Missionary Training Center president asked a federal judge in separate court filings Tuesday to dismiss a Colorado woman's lawsuit alleging the church leader raped her while she was a missionary there in early 1984. Both the church and Joseph L. Bishop say the statute of limitations on McKenna Denson's claims ran out years before she brought her allegations forward. "The purpose of statutes of limitations is clear — they are legislative expressions of public policy that encourage potential plaintiffs to bring their actions promptly, before the causes get stale from lost evidence or faulty memories," Bishop's lawyer Andrew Deiss wrote."
