I wouldn't either but no credible court is going to call that "witness tampering" unless you are arguing that the Church's counsel was to lie or to refuse to testify using non-legal justification. If you think that is the case then come out and say the Church is violating the law and drown in the deluge of CFRs.

Tampering, as with so many things, is in the eye of the beholder.
