Ca Does It Again-- Multiple Legal Parents

Got it.  Well, it looks like quite a stretch to suggest that CA's new law is going to create something similar to those 1960's communes.  After all, the premise of this law is that you have adults who actually WANT responsibility for the children.

 

The quote provided in the OP actually indicates that same gender couples were an important consideration in this law.  And, unlike your 1960's communes, same gender couples NEVER accidentally produce children.

 

What I was commenting on was the public misunderstanding of what group marriage vs polygamy is.

 

Never said it wasn't a stretch. I'm not doubting their wanting the responsibility just their ability to fulfil that moral and legal contract. My wife and have raised our grandnephew because his mother wasn't able to do it. We had/have no legal authority to do it, but we did/do have that moral responsibility. He's a great young man preparing for his Mission for the Church. I shudder to think what would have happened to him if we wouldn't have acted.

 

That is a simple function of biology for SS couples. None of my children were accidents. All were deliberate actions to produce children that were wanted from before conception. I'm happy with the three of my own. Taking care of our grandnephew wasn't an accident either. We just couidn't let him fail at such an early age.

We thought out and prayed long and hard what it would do not only for him, and to him, but also to our family. We have always taught him to love and respect his mother even if he couldn't live with her.

That's awesome that you did that for him.  And, yeah, I've never really understood what it takes to be considered a "legal guardian".

(b) The purpose of this bill is to abrogate In re M.C. (2011) 195 Cal.App.4th 197 insofar as it held that where there are more than two people who have a claim to parentage under the Uniform Parentage Act, courts are prohibited from recognizing more than two of these people as the parents of a child, regardless of the circumstances.

© This bill does not change any of the requirements for establishing a claim to parentage under the Uniform Parentage Act. It only clarifies that where more than two people have claims to parentage, the court may, if it would otherwise be detrimental to the child, recognize that the child has more than two parents.

OK, so there can be three legal parents, while the old law only allowed two.

There is still the same presumptions about parentage.  A third parent cannot be recognize without a court order. 

The old law only allowed two legal parents.  The new law allows three legal parents.

I seem to be repeating myself.

 

The legislation essentially gives the court more discretion in rare and extraordinary circumstances. 

In five or ten years California legislators simply make "minor" change to the law to remove the requirement for "court order" to "multiple partners" as an extension of SS marriage.  You truly do not understand where this is going, do you.

How very naive.  There are many things which were "unthinkable" only a few years ago.  

Again, I hope that I am wrong, but I've been around long enough to see that this legislature is part of the social engineering movement and opens the door to the unthinkable.
