I think Mr. Introvigne got this part wrong. The appeals court actual said that if Adams had waived his rights, the Church and its representatives wouldn't have had any right. See subnote 2 at https://law.justia.com/cases/arizona/court-of-appeals-division-two-unpublished/2022/2-ca-sa-2022-0047.html
As for the waiver, it is possibly unique to AZ. The court case that controls it is Church of Jesus Christ v. Superior Court (yes, another case against the Church involving child abuse). http
