Update on Story Re: Missing Kids (Daybell)

Recommended Posts

A message from Daybell that was publicly shared by, I believe, Julie Rowe (who is now distancing herself from Daybell):

Quote

Thanks for the update. The issue is that people are linking me to Julie's beliefs, which I studied but rejected. Lori and I have been absolutely silent for three months. I am constrained by my lawyers from saying more until the legal mess is complete, but be assured I will be back," the alleged message from Chad read. "Hopefully the subscribers will be there when I can fully return to GRI [an AVOW forum] and tell my experiences. I appreciate your support."

Reporting to the mods just in case against the board rules so please don't quote this post so it can easily be deleted.

They have arrested Vallow.

Here's hoping this means info soon on the kids.

According to a statement released by the Kauai Police Department, Vallow was arrested on a warrant issued by Madison County, Idaho. She is accused of multiple offenses, including desertion and nonsupport of dependent children, resisting or obstructing officers, criminal solicitation to commit a crime, and contempt of court.

They are not wanting her to go anywhere, I am guessing.

Daybell went with her, maybe arrested as well.  Added:  not arrested, news people currently don't know where he is

That is alarming to me from a Constitutional standpoint

18-401.  DESERTION AND NONSUPPORT OF CHILDREN OR SPOUSE. Every person who:
(1)  Having any child under the age of eighteen (18) years dependent upon him or her for care, education or support, deserts such child in any manner whatever, with intent to abandon it;
(2)  Willfully omits, without lawful excuse, to furnish necessary food, clothing, shelter, or medical attendance for his or her child or children, or ward or wards; .....

Does Idaho have any evidence of abandonment or willful omits to provide?

Yes there is contempt of court but the condition and whereabouts of the Children are unknown so on what basis could Idaho charge ... this also makes me think she has a good chance at not getting extradited.

I am thinking they have something more given they included solicitation to commit a crime.

But it might have been triggered by fear they were going to leave the country.

Ah good point about the solicitation, for some reason I thought HI PD was charging her with that.

It is confusing.  I was thinking the resisting officers would be Hawaiian based, but they fled Idaho after the cops showed up as well as lied to them, so that may relate to much earlier and be more obstruction.

It is 4 PM in Hawaii.  Bet they will just let her sit in jail all night as likely evening by the time processing is over.

added:  the solicitation count appears to be persuading someone else to lie to the police about the kids...maybe Daybell, I am guessing.

From twitter.  Won't link now, waiting for update in east Idaho paper.

Tylee's account had a picture of her in Yellowstone dated Sept 8.  That is the last known whereabouts.

Yellowstone apparently has a reputation of a deathzone as overlapping jurisdictions and other facts complicate investigations to the point that some people imagine they don't take place.

Basically all the new info until the press conference.

This is probably the best place to go for up to the minute updates.

Hearing is at 1 PM HST, which is I think 4 PM MST and press conference at 3, so 6 PM MST.

One more detail because it makes me ill so I must share...

Daybell got $430,000 life insurance from his wife's death.

I suspect the insurance company is waiting to see what happens with the autopsy results.

He married Vallow a few weeks after his first wife's death.  Then he and/or Vallow started lying/misleading about the kids' whereabouts.  Then he and Vallow disappeared Vallow's kids.  Then he and Vallow took off to live the high life in Hawai'i, presumably having been bankrolled by the life insurance payout.

I have a hard time believing Julie Rowe, who has claimed that Daybell predicted his wife's death.  But if there is competent, credible evidence that Daybell "predicted" his wife's demise, then that plus the above behaviors combine to make premeditation more apparent and likely.

Thanks,

-Smac

He married her in November iirc, two weeks after his wife died in October.  Kids went missing early and late September.  Chad was involved in the coverup (lied saying he didn't know Vallow well after they were married, tried to convince a friend to tell cops JJ was with her), so could be charged as accessory after the fact I am guessing (correct term?).

Websleuths (which I have been using to keep up) has been excellent to treat the Church and members with respect.  I have seen comments along the line of 'more evidence Church is a cult and full of crazies' elsewhere though.

I think the Lafferty Brothers were the only ones motivated by religious zealotry/extremism.  The others were members of the Church, but did not appear to have any religious motivation for their crimes.

She is fighting it and wants to drop bail to $10,000

My blood boiled a bit when the attorney was talking about what she was charged with as just a couple of felonies and misdemeanors that would on,y result in fees if tried in Hawaii.

Yes, judge blew off the request to drop it.

Hearing, which is to confirm she is who they really want (compare fingerprints and witnesses), is March 2nd.  I assume there will be other arguments besides "she's not Lori Vallow".  Maybe some lawyers could explain.

Added:  from EastIdahoNews:

Quote

Daybell’s defense attorney, Daniel Hempey, asked for his client’s bail to be drastically reduced to $10,000 on the basis that such a high bail doesn’t fit a couple of felony and misdemeanor charges. He told the judge that Daybell lives on Kauai with her husband, Chad Daybell, and has remained in the state since her lawyers made contact with police in January. He addressed the couple’s recent weekend “vacation” to Maui – saying defense attorneys told police they would produce her to law enforcement when they wished to arrest her.

“Instead she was arrested and media was calling us all day,” Hempy said. “It seems like it was a made-for-media event at taxpayer expense.”

Kollar argued Daybell should be denied bail as child abandonment is a serious crime in Hawaii and there is a risk she might flee.

“We are asking that Ms. Vallow be remanded without bail,” Kollar said. “She has already absconded from the jurisdiction where the underlying crime is alleged to have taken place.”

Additionally, Kollar that Daybell is a risk to the public and had previously tried to obstruct justice.

“She has no ties to this island other than a rented condominium in Princeville,” Koller said. “She apparently has resources to travel and leave.”

Court documents indicate Chad Daybell had obtained $430,000 from life insurance on policy his wife Tammy Daybell, who died on Oct. 19, 2019. The death came just two weeks before Chad and Lori Daybell married on the beaches of Kauai.

“If ever there was a case suitable, and you know our office doesn’t request this on a regular basis, that a person be denied bail, this is the case that is appropriate for that,” Kollar said.

Kollar was very impressive, polished; Hempey seemed tired and very nervous, annoyingly used his hands in expansive gestures...think he needed to be walking; probably wasn't used to cameras or maybe the attention...or maybe he doesn't like the case.  I was thinking "do you actually believe what you are saying!?"  Vallow looked pretty disdainful and exhausted throughout, she shook her head a little when her attorney said she wasn't a danger to the community (because of all reasons the kids weren't there, so no need to worry, right?) as if to say "no, I am so harmless".  Then she was looking expectant for the bail and when the judge casually said $5 million, her eyes closed a few seconds as if bracing herself.  Daybell just sat there like a statue with a chilled frown.  He and her lawyer took off fast.  There didn't seem to be any exchange between the two from Vallow's side, she was just looking at her lawyer and the officers escorting her.

I am not watching much news of this type lately - what's the deal- they have some link to the church or something?

Became aware today because of the arrest

Why is this thread here?  To me it's just a crime story.... ??

I got the feeling she thought she was a Goddess and the rest of us are peasants. Perfect description too Calm. And Chad's face was hilarious. Hope they move her to Rexburg soon.

Many links to the church. Maybe read the thread from the beginning?
